For Approval: Consultation Response on Digital Fairness Act

Background:

The Digital Fairness Act is an upcoming European Commission initiative, which aims to tackle some grey areas in the digital economy rulebook, such as dark patters, unfair personalisation and pricing practices, addictive designs (particularly for online videogames), influencers’ misconduct and issues with digital contracts.

DIGITAL SME’s response stresses that new legislation should only be considered after a thorough evaluation of the existing rules, given that current EU laws already address many of these issues and that better enforcement may be more effective than additional regulation. If new rules are introduced, they should target primarily those large platforms who rely on these manipulative business practices while exempting small and medium enterprises to avoid disproportionate compliance burdens that could stifle innovation and growth.
