Focus Group AI – Adapting liability rules to the age of AI
As technological advancements roll out, it is important that guarantees are put in place to ensure that European businesses and consumers benefit from the highest standards of protection and legal certainty. Furthermore, a harmonised legal framework is essential to avoid the risk of regulatory fragmentation that is brought by emerging technologies.
In this light, the European Commission announced the Proposal for an Artificial Intelligence Liability Directive (AILD). The proposed new rules would enhance users’ avenues for redress whenever they experience any harm related to AI-powered software and products. In short, the aim is to update the existing civil liability rules to make them fit for the digital age.
For small and medium enterprises, looking at the proposed AI Liability Directive early on could help anticipate how the existing liability rules will be applied, and thus assess and insure their liability exposure. Moreover, effective liability rules would help boost trust towards AI systems and accelerate their uptake in the Single Market.
Hence, in the meeting of Focus Group AI, was discussed:
- How does the proposed AI Liability Directive address the damages that are caused by AI systems?
- How will the new rules contribute to SME innovation and development in the field of AI?
- What is the civil society’s view on the issue of liability rules for AI?
